These Terms & Conditions (“Terms”) govern your access to and use of the Kijarney website and services (the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 18 years old to create an account or use the Service. By registering or using the Service you represent and warrant that you are 18 or older.
2. Account Registration & Security
- You agree to provide accurate, current and complete information during registration and to update such information to keep it accurate.
- You are solely responsible for safeguarding your password and account credentials. Do not share credentials. If you believe your account has been compromised you must notify us immediately.
- We recommend using a strong, unique password and enabling any available security features. We are not responsible for losses due to compromised credentials.
3. Session Storage & Cookies
We use sessions and cookies to maintain login state and provide the Service. Session content stored on the server (for example in the database) is encoded by the session store and may appear in the database as serialized data. The presence of multiple session rows in the session table indicates multiple active/previous sessions — it does not, by itself, identify which user is “currently” logged in; the active session is determined by the session cookie held in the browser.
If you log out or your session expires, the session cookie in your browser will be invalid and a new login will create a new session record. We strongly recommend using a proper session store in production (for example MySQLStore, Redis, or similar) rather than the default in-memory store.
4. User Content & Licenses
- You retain ownership of content you post to the Service (text, images, videos, comments, messages — “User Content”).
- By posting User Content you grant Kijarney a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, modify, publish, and display the content within the Service and on affiliated platforms, solely for providing the Service.
- You confirm that you own or are authorized to post User Content and that the content does not infringe any third-party rights (including copyrights, trademarks, privacy or publicity rights).
5. Prohibited Conduct
You must not use the Service to:
- Engage in illegal activity, fraud, or money-laundering.
- Post or distribute content that is hateful, pornographic, obscene, violent, harassing, defamatory, or that violates privacy or intellectual property rights.
- Transmit viruses, malware, or any code intended to disrupt or damage the Service or other users.
- Attempt to probe, scan, or test the vulnerability of the Service or to breach security or authentication measures without our written permission.
6. Moderation, Removal & Reporting
- We reserve the right (but are not obligated) to monitor, review, remove, or refuse any content that violates these Terms or is objectionable, without prior notice.
- If you encounter illegal content, harassment, or other violations, report it to us immediately at support@kijarney.co.ke. We will make reasonable efforts to investigate and respond.
- We may suspend or terminate accounts at our discretion for violations of these Terms.
7. DMCA & Copyright Infringement
If you believe content posted on Kijarney infringes your copyright, provide a takedown notice containing the following information: identification of the work claimed to be infringed, identification of the material claimed to be infringing and its location, your contact information, a statement under penalty of perjury that you are the copyright owner, and your signature. Send notices to: copyright@kijarney.co.ke.
8. Third-Party Services & Links
The Service may contain links to third-party websites, integrations, or payment processors. We do not control and are not responsible for the content, privacy practices, or policies of third parties. Use third-party services at your own risk.
9. Advertising, Payments & Fees
- We may display ads or offer paid features. Pricing, billing, and terms for paid features will be provided separately. You are responsible for any fees and taxes associated with paid services.
- Payment processing is handled by third-party providers; you agree to their terms when you purchase services.
- All purchases are final unless otherwise stated; refunds are provided at our sole discretion and according to any separate refund policy.
10. Security & "Beginner Developer" Disclaimer
You acknowledge and accept that Kijarney may be built or maintained by developers who are learning. While we will make reasonable efforts to secure the Service and apply best practices, we do not guarantee that the Service is free from vulnerabilities, bugs, or security flaws.
By using the Service you accept the risk of data breaches, loss, or unauthorized access. We will not be liable for damages resulting from security incidents beyond our direct, demonstrable negligence.
11. Backups & Data Retention
We may perform backups and retain certain data for operational, legal, or compliance purposes. If you delete your account, copies of your data may remain in backups for a reasonable period. We are not responsible for retrieving deleted content after account deletion.
12. Disclaimers — No Guarantees
The Service is provided “as is” and “as available” without warranties of any kind. We expressly disclaim all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability & Cap
To the maximum extent permitted by law, Kijarney, its officers, owners, agents and affiliates shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including lost profits, loss of data or goodwill, even if advised of the possibility of such damages.
Our total aggregate liability for direct damages arising from or related to these Terms will not exceed an amount equal to the fees paid by you to Kijarney in the twelve (12) months before the event giving rise to the claim, or if you have not paid fees, an amount of USD 100, whichever is lower.
14. Indemnification
You agree to indemnify, defend and hold harmless Kijarney and its affiliates from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your User Content, or your violation of any law or third-party right.
15. Termination
- We may suspend or terminate your access at any time for any reason, including if you breach these Terms or we suspect fraud or illegal activity.
- On termination we may delete or retain your User Content and account data as required by law or for legitimate business purposes.
16. Dispute Resolution & Governing Law
These Terms are governed by the laws of Kenya. You agree that disputes will be resolved in the courts located in Kenya unless we agree to arbitration. If you want a binding arbitration clause or a different dispute process, consult legal counsel — this template does not force arbitration by default.
17. Force Majeure
We shall not be liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, acts of war, strikes, internet outages, or acts of government.
18. Changes to These Terms
We may modify these Terms at any time. We will post the revised Terms with an updated Effective Date. Your continued use after such changes constitutes acceptance.
19. Notices
Notices to you will be sent to the email associated with your account or posted on the Service. Notices to us should be sent to: support@kijarney.co.ke.
20. Severability & Entire Agreement
If any provision is held invalid, the remainder of the Terms shall remain in effect. These Terms (and the documents referenced herein) constitute the entire agreement between you and Kijarney regarding the Service.
21. Acknowledgement
By using the Service you acknowledge that you have read and understood these Terms and agree to be bound by them.
